Sorry for the late post. I've been on vacation skiing for a while. 40 inches of new powder in 72 hours at Steamboat, Colorado. Skiing was fantastic!
There are at least three ways to look at the lists (and the headings) issue.
Formatting purist view

In most word processors, including Word, lists and headings are attached to paragraph style (in fact they are the same thing) and have no structural implications other than those implied by the style.
OpenOffice view
---------------
In the view of OpenOffice it is very useful to specifically call out lists and headings as structure. It therefore makes sense to add this structure to the XML format even though the OpenOffice application itself does not really expose this structure to the user.
Structure purist view
---------------------
Adding headings to openoffice using a text:h instead of text:p is not real structure. If we are going to have headings they should contain the information they are the heading of.
I'm not sure which one is the correct way to go with this specification. Have to jump on the call now. I'll try to finish my thoughts this week...
